These General Terms and Conditions of Sale govern all the rights and obligations of the buyer and of the seller for all orders placed remotely via the Internet site “www.munich-garage.com” to Cyprus (for other EU countries, please contact us).

Please read the General Terms and Conditions of Sale carefully before using our website. By checking the box “I accept” in the section “Payment method” when placing his order on the MUNICH GARAGE Internet site, the Customer declares, without any reservation, to have read and accepted these applicable terms and conditions which are in force when the order is validated. Do not continue to use the site if you do not accept all of the terms and conditions stated on this page. Terms and Conditions may be modified and posted on our Website from time to time, so the Customer should carefully read them prior to placing any order.

PREAMBLE

This site is published by the  under the name “STEFANOS STEFANIDIS” and the distinctive title “MUNICH GARAGE”, having its registered seat in Glyfada Attica, 112 Saki Karagiorga, P.C. 166 75, Greece, holding the Tax ID number EL 047328451.

It can be accessed by the Internet at the following address: www.munich-garage.com (hereinafter the “Site”).

These general terms and conditions (hereinafter the “General Terms and Conditions of Sale”) govern without restriction the sales of products (hereinafter “Products”) made between MUNICH GARAGE and the Customers on the site www.munich-garage.com. Any order of a Product offered on the Site implies the Customer’s full acceptance of these General Terms and Conditions of Sale. They constitute, with the validation and confirmation of the order and the Customer’s payment, the contract concluded between MUNICH GARAGE and the Customer.

ARTICLE 1

PURPOSE

These General Terms and Conditions of Sale govern the rights and obligations of the Parties resulting from the sale of Products offered on the Site.

The information set out in these General Terms and Conditions of Sale and the presentation of the Products to be purchased by the Customers contained on the Site constitutes an invitation to treat by MUNICH GARAGE to non-trader individuals who operate for purposes which exclude any professional or commercial activity (hereinafter referred to as “Customers”), is not binding for MUNICH GARAGE and do not constitute an offer for sale in the legal sense of the term.

The validation of these General Terms and Conditions of Sale, the order summary sent to the Customer by email and the Customer’s payment constitute proof of the conclusion of a contract between MUNICH GARAGE and the Customer, which will be governed by these Terms and Conditions. The contract is terminated upon delivery of the Products to the Customer or his designated third party.

Customers must be of legal age and have the legal capacity to conclude such a contract, otherwise it will not be valid.

MUNICH GARAGE reserves the right to withdraw from the contract if, after the confirmation of the order, it receives commercial information about the Customer that, at its sole discretion, makes it inadvisable to execute the contract; exercising this right does not entitle the Customer to any compensation for damages or anything else. Furthermore, in case of repeated returns from the Costumer, MUNICH GARAGE reserves the right to refuse to accept the product return due to abuse of the right of withdrawal or replacement of the products, even if they meet the terms and conditions laid down in articles 8 & 9 of the present.

ARTICLE 2

PRODUCTS

The Customer can find out about the various Products that MUNICH GARAGE sells on the Site. The Customer may navigate freely on the pages of the Site.

Τhe Products are presented using an information sheet (product description, photograph, price, product code, etc.) containing information that is as correct and precise as possible to give as faithful and complete a description as possible. The Customer may obtain extra information on the products presented on the Site by sending an e-mail to info@munich-garage.com, or by telephone to +30 2109600100. The presentation of the Products to be purchased by the Customers contained on the Site is not binding for MUNICH GARAGE and does not constitute an offer for sale in the legal sense of the term.

The photographs, diagrams, drawings or videos illustrating the products are not contractually binding. Under no circumstances shall MUNICH GARAGE be held liable for any errors that may occur.

The Customer may purchase any Product presented as available and at the price indicated on the Site on the day he places his order. If the Products are unavailable after the order has been finalized, MUNICH GARAGE will inform the Customer at the earliest opportunity by telephone or e-mail subject to the provisions of Article 3 below.

The Products are limited to Customers residing in Cyprus. MUNICH GARAGE reserves the right to refuse a sale if the Customer requires a shipment outside Cyprus. In the event where MUNICH GARAGE accepts, however, to proceed with a shipment outside Cyprus, it will inform the Customer of the amount of the specific delivery costs to expect, in addition to its usual preparation costs.

The products will be at the Customer’s risk from the time of delivery.

Ownership of the products will only pass to the Customer when MUNICH GARAGE receives full payment of all sums due in respect of the products, including shipping charges, or upon delivery whichever is the later.

ARTICLE 3

PRODUCT PURCHASES – ORDERS

On the Site the Customer shall find step by step information about the process he should follow to complete his order. The Customer shall be given helpful advice on identifying and correcting potential errors when placing his order (e.g. selection of the type, quantity, payment terms etc.).

1. Registration

For safety reasons, the Customer, before submitting the purchase order may create a customer account by following the registration procedure and by providing the necessary information, which will be protected in compliance with Article 12 of the present. In case the Customer does not wish to register and create an account, he may continue his purchase as guest customer, providing only the necessary for the notice of payment and shipment details.

The accuracy of the personal data provided by the Customer falls within his exclusive responsibility. In no event he will be checked for his accuracy, and MUNICH GARAGE may not in any case be held responsible if certain incorrect information hinders the proper execution of an order or a delivery. The Customer will be bound by all orders placed on this Site in their personal account, subject to the exercise of their right of withdrawal, as provided in Article 8 below.

2. Purchase order

The purchase of the products is submitted by filling in and sending the special Order Form. Once the content of the shopping basket is validated, the Customer can confirm his order by completing the following steps:

  • Confirm the products and qualities selected;
  • Complete the information requested by the Site;
  • Accept without any reservation the General Terms and Conditions of Sale, by clicking on the button indicated;
  • Validate the payment, by clicking on the button indicated.

With the above confirmations and validations, the Customer expressly and unreservedly declares that, before submitting his order, he has received in a clear and comprehensible manner the information described in articles 8 & 9 of the present.

Placing the order to MUNICH GARAGE is an offer for the purchase of the goods ordered. If there is no follow up or acceptance, the Customer is entitled to a refund of this payment.

The order is not binding for MUNICH GARAGE before the Customer receives the Confirmation of Acceptance of the order by MUNICH GARAGE, as described below.

The order is deemed to have been received by MUNICH GARAGE from the moment the Customer receives an order status update e-mail with the indication “Confirmation of Order Registration”. During the processing of each registered order, the stock availability of the order’s products is confirmed. If the availability or delivery time differs from the one listed on the product page, the Customer will be informed accordingly. The order is considered definite and binding and the sales contract between the parties (the Customer- MUNICH GARAGE) is deemed to have been established only on sending and receiving an e-mail with the Confirmation of Acceptance of the registered order, with the words [“Your order has been shipped”].

In the unlikely event of unavailability of a product after the validation of the order and payment, the Customer may, at his request:

  • Either be delivered the products, which are available and reimbursed the amount, including taxes, of the unavailable products in his order;
  • Or cancel the entire order and be reimbursed its amount, including taxes and delivery costs;
  • Or request the delivery of a product of an equivalent quality and price, within the limit of available stocks.

The reimbursement will be made via the same payment method as the one used by the Customer to pay the amount of their order, within thirty (30) days of the confirmation of the choice of the mode of compensation of the Customer.

  • Order of products that are not in stock

In the event that the Customer orders products that MUNICH GARAGE does not normally have in stock, MUNICH GARAGE will typically add a small deposit for the product concerned. The amount of the deposit will be 30% of the products price excluding VAT, which the Customer has to pay in advance using one of the accepted payment methods listed in article 7 below.

3. Refusal of order

MUNICH GARAGE reserves the right to withdraw any products from the Site at any time and/or remove or edit any materials or content on the Site. Whilst MUNICH GARAGE will make its best efforts to always process all the orders, there may be exceptional circumstances, which mean that MUNICH GARAGE may need to refuse to process an order after it has sent the Customer an Order Confirmation, which MUNICH GARAGE reserves the right to do at any time, at its sole discretion.

MUNICH GARAGE will not be liable to the Customer or any other third party by reason of our withdrawing any product from the Site, whether it has been sold or not, removing or editing any materials or contents on the Site or for refusing to process or accept an order after it has sent the Customer the Order Confirmation.

ARTICLE 4

PRICES

The prices of the various products are given in euros (€) and exclude Value Added Tax (VAT). The prices are net, before shipping costs. The total price before checkout include VAT(24%). The VAT is the one in force on the territory on the day of the Order. The prices of the various products do not include any after—sales service costs.

MUNICH GARAGE reserves the right to change his prices at any time at is sole discretion. The products, if available, shall nonetheless be invoiced in euros at the rates in force when the order was recorded. Placing an order implies accepting the price given for the chosen product.

Shipping costs, where relevant, are given separately when the Customer processes his order and must also be paid at the time of completing his order in accordance with the provisions of Article 5 below.

The total price given in the order confirmation is the final price, including VAT and shipping costs.

ARTICLE 5

SHIPPING & DELIVERY OF PRODUCTS

The shipping costs are communicated to the Customer when he places his order and adjusted according to the place and address of delivery requested. These costs are borne by the Customer and are invoiced in addition to the sale price of the Products. In the event where MUNICH GARAGE accepts to deliver an Order outside Cyprus, all the customs procedures and possible costs remain at the exclusive charge of the Customer.

The price of the Products and the shipping costs are to be paid in full by the Customer when the Order is placed using one of the accepted payment methods listed in article 7 below. They are indicated in the Order confirmation sent by MUNICH GARAGE to the Customer. The shipping costs are automatically calculated based on dimensional weight (using the weight AND size of the package) and the Customer is being informed accordingly before he places his order.

The Products will be delivered to the Customer after validation of the payment of the Order, whatever the method. The Customer will be informed of the shipment of the Products by email. In the event where the Order includes Products whose availability dates differ from the time when the Order was placed, it will be shipped when all the Products are available, in a single dispatch.

The delivery of Products is carried out by a specialized courier company (TNT SKYPAK HELLAS LTD courier) with tracking. MUNICH GARAGE reserves the right to unilaterally change the courier company at any time.

Subject to availability, the delivery period for Products will be indicated to the Customer when he places the Order and prior to confirmation of the Order and payment by the Customer. MUNICH GARAGE will make its best effort to ensure that the Order, accompanied by a delivery slip, is delivered in a period between two (2) and five (5) business days as of receipt of Customer’s payment. In any event, all Products purchased on the Site will be delivered to the address indicated by the Customer when he places his order within a maximum period of thirty (30) business days as of the day following receipt of payment of the Order.

If for some reason MUNICH GARAGE is unable to deliver on this date, it will inform the Customer of this situation and give him the option to continue with the purchase with a new delivery date or alternatively cancelling the order and reimbursing him with the full amount paid.

However, the delivery may not be guaranteed in the case of a force majeure event subject to article 15 below.

If MUNICH GARAGE is unable to deliver the goods due to an incorrect or incomplete address, the order will be resent to the Customer only at his own expense.

ARTICLE 6

CUSTOMS FEES

Any order placed on the website and shipped outside Greece may be subject to taxes and customs fees when it reaches its destination. The expense of the taxes and customs fees related to the delivery of an item are the responsibility of the Customer alone. MUNICH GARAGE is not required to find out about and inform the Customer of any customs fees and taxes which may apply. MUNICH GARAGE advises the Customer to contact the competent authorities in his/her country for further information on this matter.

ARTICLE 7

PAYMENT METHODS

The online shop of MUNICH GARAGE is governed by Greek law and the items offered for sale on the site are all shipped from Greece. Invoices are drawn up in euros, subject to Greek VAT of 24% and shipping costs subjected to 24%.

CREDIT/DEBIT CARD

Use of his credit / debit card for his online purchases at the MUNICH GARAGE Site is perfectly safe if the Customer follows the respective instructions. As soon as the Customer fills in all the details required for placement of his order, he will be automatically redirected to a secure site of the partner bank (Eurobank S.A.) where he can fill out his credit / debit card details online directly.

To pay by credit / debit card, the Customer must complete the relevant form indicating the exact name of the holder, the number and expiration date of his credit card, and the three-digit number (CVV) located on the back of the card.

Checking of details and payment is made directly, once the Customer is connected to the cooperating bank (Eurobank S.A.).

MUNICH GARAGE reserves the right to suspend the processing of an order if payment by bank card is denied or payment is not made. In these circumstances, MUNICH GARAGE may consider the sale to be cancelled.

MUNICH GARAGE guarantees full confidentiality of bank information secured by the SSL protocol, which automatically checks the Customer’s right to use the bank card and encrypts all transactions to ensure confidentiality.

WIRE TRANSFER

MUNICH GARAGE accepts bank wire transfers as a valid form of payment. If the Customer would like to use a wire transfer to pay for his order, he must have his bank electronically transfer the total euro amount of his order referencing his name and web order number to:

Once the transaction has been completed, the Customer must send to MUNICH GARAGE by e-mail the proof of payment.

Processing time varies among banking institutions and can be delayed. The Customer must allow 2 business days for the processing of their wire transfer.

MUNICH GARAGE reserves the right to automatically suspend the processing of an order if payment by bank transfer is denied or payment is not made within 3 days from the placement of the order. In these circumstances, MUNICH GARAGE may consider the sale to be cancelled.

The Customer bares the bank charges for the transaction by wire transfer.

PAYPAL

Once the Customer finishes completing all other details required for placement of his order, he will be automatically redirected to Paypal’s secure site, where he can either register his credit / debit card details online or login to his existing PayPal account and use the payment information he already has recorded there.

MUNICH GARAGE reserves the right to suspend the processing of an order if payment via Paypal is denied or payment is not made. In these circumstances, MUNICH GARAGE may consider the sale to be cancelled.

ARTICLE 8

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the contract within 14 days without specifying a reason.

The Customer has the right to withdraw from the contract without specifying a reason within 14 days from the day after delivery of goods, i.e. from the day when the Customer or his designated third party received the goods. The withdrawal period will then expire.

For the purposes of exercising the right to withdraw from the contract, the Customer must so inform MUNICH GARAGE of his decision to withdraw from the contract by an unequivocal statement by e-mail at: info@munich-garage.com.

The Customer may use the template for contract withdrawal, though it is not required.

In order to comply with the time limit of withdrawal from the contract, the Customer need only to send the request to withdraw from the contract before the respective time period elapses.

Consequences of withdrawing from the contract

MUNICH GARAGE will return the Customer’s payment only after it receives the returned items or proof that the Customer has sent the items back, whichever comes first:

  1. Receipt of goods: The Customer must return or submit the goods to MUNICH GARAGE without undue delay, within 14 days from the withdrawal of the contract at the latest. In order to comply with the return period, items must be sent within 14 days.
  2. Expenses related to product returns. The Customer will be responsible for all expenses related to product returns.
  3. Responsibility for depreciation in value of returned items: The Customer is only responsible for depreciation in value of items resulting from handling these items in a manner that is inconsistent with the nature and character of the items, including their functionality.

The refund process will be completed at the latest within 14 days of receipt of the goods assuming they are in perfect condition.

For successful and easy returns, MUNICH GARAGE asks that the Customer follows the procedures below:

  1. Contact MUNICH GARAGE with his request for withdrawal from the purchase contract, listing the number of the order, date of purchase and receipt of goods. After review, MUNICH GARAGE will ask the Customer to submit a written request for withdrawal from the contract and to return the items in question.
  2. The Customer must send the complete request with a copy of HIS order by e-mail to our invoice address.
  3. The Customer must send the items in question via registered, insured post to MUNICH GARAGE’s invoice address. MUNICH GARAGE is not responsible for loss or damage of return shipments. The items must be intact (including all documents and accessories), unused and repacked so that the original packaging is not damaged during transport. The Customer must not send the returned goods by cash-on-delivery (such shipments will not be accepted).
  4. The Customer will be reimbursed the respective amount in the same form as his original payment.

Contract withdrawal is not possible if items are returned damaged (including damage to the original packaging), used or incomplete (missing documentation, warranty certificates, accessories, etc.).

Withdrawal from the purchase contract will not be approved upon failure to meet any of the conditions mentioned above. Items will subsequently be returned at the Customer’s expense or stored in the MUNICH GARAGE’s warehouse.

ARTICLE 9

LACK OF CONFORMITY AND/OR PRODUCT DEFECTS

  1. MUNICH GARAGE shall be liable to the Customer for any lack of conformity and/or a product defect which exists at the time the goods were delivered.
  2. In the case of a lack of conformity and/or a product defect, the Customer shall be entitled to have the goods brought into conformity free of charge by repair or replacement, in accordance with paragraph 3, or to have an appropriate reduction made in the price or the contract rescinded with regard to those goods, in accordance with paragraphs 5 and 6.
  3. In the first place, the Customer may require MUNICH GARAGE to repair the goods or he / she may require the seller to replace them, in either case free of charge, unless this is impossible or disproportionate.

A remedy shall be deemed to be disproportionate if it imposes costs on the seller which, in comparison with the alternative remedy, are unreasonable, taking into account:

– the value the goods would have if there were no lack of conformity,

– the significance of the lack of conformity, and

– whether the alternative remedy could be completed without significant inconvenience to the Customer.

Any repair or replacement shall be completed within a reasonable time and without any significant inconvenience to the Customer, taking account of the nature of the goods and the purpose for which the Customer required the goods.

  1. The terms “free of charge” in paragraphs 2 and 3 refer to the necessary costs incurred to bring the goods into conformity, particularly the cost of postage, labour and materials.
  2. The Customer may require an appropriate reduction of the price or have the contract rescinded:

– if the Customer is entitled to neither repair nor replacement, or

– if MUNICH GARAGE has not completed the remedy within a reasonable time, or

– if MUNICH GARAGE has not completed the remedy without significant inconvenience to the Customer.

  1. The Customer is not entitled to have the contract rescinded if the lack of conformity is minor.
  2. The Customer must check and make any claims directly to MUNICH GARAGE via e-mail at: info@munich-garage.com with acknowledgment of receipt, within 24 hours of receiving the goods.
  3. The Customer will be responsible for all expenses related to product returns.

ARTICLE 10

CANCELLATION OF ORDERS

Since an order is registered on the Site, the cancellation is possible subsequently to the order by e-mail to info@munich-garage.com, since it is sent and received by MUNICH GARAGE before 9:00 am on the day of receipt of the order, and the products are not delivered for shipment. For the customer’s convenience, it is preferable to know the number of the order.

ARTICLE 11

Warranty Policy

All the products presented on the MUNICH GARAGE site are covered solely by the warranty, terms and time-period provided by their manufacturing plant, and which do not in any way bind MUNICH GARAGE. The provided by MUNICH GARAGE products are accompanied by written instructions, as well as by a good performance guarantee of reasonable duration, in English language. The warranty form always incudes the name and the address of the guarantor, the product to which the warranty refers, its exact content, its duration, the local area that the warranty is in force, as well as the provided by the applicable law rights. Unless otherwise stated in the warranty form or the information sheet of the Product on the Site, the warranty is valid for two (2) years. The warranty of the product, according to the manufacturer, comes into force from the date of purchase and provides for a free repair of the problem, as long as the below terms are fulfilled:

  1. The Customer has kept the warranty and the receipt of product purchase;
  2. The stable features of the product have not been altered;
  3. The damage is not excluded according to the warranty form of the manufacturer.

ARTICLE 12

PERSONAL DATA

Any user may browse the online store www.munich-garage.com without providing any personal information. The cases where MUNICH GARAGE will need some personal details (name, email address, shipping address, phone, etc.) is generally for processing of the Customer’s order.

Customers’ personal data is stored in accordance with current Greek laws.

By entering into purchase contract, the Customer agrees with the processing and collection of his personal data in the MUNICH GARAGE’s database following the successful completion of the contract unless he submits in writing via e-mail at info@munich-garage.com his non-consent with this processing.

The Customer has the right to access and alter his personal data, as well as other rights related to such personal data, as stipulated by General Data Protection Regulation (GDPR).

Personal data can be removed from the database upon a written request via e-mail at info@munich-garage.com by the Customer.

In any event, MUNICH GARAGE informs the Customer of his rights for access, correction, deletion, and opposition in accordance with  General Data Protection Regulation (GDPR).

The Customers’ personal data is fully protected from misuse or abuse. MUNICH GARAGE does not give out the Customers’ personal data to any third party. Exceptions include external carriers, to whom only the information necessary for product delivery is given.

MUNICH GARAGE may periodically use the Customer’s e-mail to inform him of the availability of similar products and services on the site. In the event, however, that the Customer does not wish to receive such messages, he must submit his request to MUNICH GARAGE at info@munich-garage.com.

Credit card details are not saved on MUNICH GARAGE’s Site.

ARTICLE 13

COOKIES

When accessing the Site data is automatically collected by one or more small file(s) – so-called Cookies – which are sent to the Customer’s computer and saved automatically. This collected data cannot be assigned to a specific person. The data notably includes such as the Internet browser and the operating system used, the domain name of previously visited webpages, the number of visits to our websites, visited websites or the average residence.

MUNICH GARAGE uses Cookies namely to collect user-related data during the visit to our websites or over several visits (session management), to store information about the users of our websites based on their usage preferences, in order to show them relevant content in the future (personalization) or to track the behavior of users on the Internet (tracking).

For the storage of preferences and data that are needed during a visit to the website (session management and personalization), MUNICH GARAGE uses first-party Cookies, this means Cookies that belong to the domain that appears in the address bar of the browser. To keep track of user trends and patterns (tracking) MUNICH GARAGE uses third-party Cookies, this means Cookies that do not belong to the domain that appears in the address bar of the browser.

The data thus collected MUNICH GARAGE uses to continuously improve the quality of our services, to evaluate the attractiveness of our websites and to improve the performance and the content of our websites. Collected data from third-party Cookies are processed by third parties on our behalf. Third-party Cookies are exclusively used by our websites and the provider of web statistics and are not shared with other third parties.

The Customer can set his browser so that all Cookies will be rejected or that the Customer will receive a message when a Cookie is being sent. However, some functions or services on our websites will not work properly or will not work at all without Cookies.

ARTICLE 14

SECURITY POLICY

MUNICH GARAGE is committed to protecting the Customer’s personal information. The online store www.munich-garage.com uses SSL technology (Secure Sockets Layer). This specific protocol, SSL (Secure Sockets Layer), is now the global standard for certification of online sites. With this technology, any information the Customer enters on the Site is encrypted/encoded before it comes online, thus protecting personal information during transmission. Furthermore, all information sent using SSL are protected by a mechanism that automatically checks whether data has been changed in transit.

Encryption is basically a means for encoding information until it reaches the recipient, who will be able to decode it using the appropriate key.

MUNICH GARAGE reserves the right to disclose any information to the extent it reasonably believe that disclosure is required by law, to enforce our website policies or to protect our customer’s or others’ rights, property or safety.

The Site may contain links to other webpages, these webpages are not covered by this Policy. Although MUNICH GARAGE strives to link only webpages that adhere to the same high privacy policies as ours, we are not responsible for the privacy policies or the content of such other webpages.

The information and content of third parties or links to third party websites contained on the Site are provided solely for the Customer’s convenience and information.

MUNICH GARAGE has no influence and no control over the information and content of third-party websites, assumes no responsibility or warranty for such information and content and makes no representations in this regard. This includes in particular the accuracy, content, quality and timeliness of these websites.

Article 16

INTELLECTUAL PROPERTY

The online store www.munich-garage.com and trademarks that represent MUNICH GARAGE and its online shop are the intellectual property of the Company and are protected in accordance with the relevant provisions of Greek law. As such, any use of the afore mentioned content is strict; prohibited without the express written permission of MUNICH GARAGE.

ARTICLE 17

TRANSFER OF RIGHTS AND OBLIGATIONS

The contract between the Customer and MUNICH GARAGE is binding on the Customer and MUNICH GARAGE and on their respective successors and assigns.

The Customer may not transfer, assign, change or otherwise dispose of a Contract, or any of his right or obligations arising under it, without MUNICH GARAGE’s prior written consent.

MUNICH GARAGE may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of its rights or obligations arising under it, at any time during the term of the Contract. For the avoidance of doubt, any such transfer, assignment, charge or other disposition will not affect Customer’s statutory rights as a consumer or cancel, reduce or otherwise limit any warranty or guarantee which may have been provided by MUNICH GARAGE to him, whether express or implied.

ARTICLE 18

PROOF

The Customer is informed that the computer records, kept in MUNICH GARAGE’s IT systems in reasonable conditions of security, will be considered as proof of communication of orders and of the payments made between the parties.

ARTICLE 19

FORCE MAJEURE

The performance of the obligations of MUNICH GARAGE may be suspended in the case of a Force Majeure event, as defined by the case law of the Greek Courts, which may prevent such performance.

MUNICH GARAGE will inform the Customer of the occurrence of a force majeure event within seven (7) days of its occurrence. In the event where this suspension continues after a period of 30 (thirty) days, the Customer will have the possibility to terminate the Order in progress affected by the Force Majeure, and will then be reimbursed the price of the Products ordered and for the delivery costs paid.

ARTICLE 20

CODE OF CONDUCT

In an effort to build consumer confidence in e-commerce, MUNICH GARAGE follows the Greek E-Commerce Code of Conduct setting out the minimum standards of ethical business conduct to be applied in the online commercial relations between business and consumers. The Customer can access the Code here.

ARTICLE 21

ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS

Any order made by the Customer and all deliveries made by MUNICH GARAGE imply full and unconditional acceptance by the Customer of the General Terms and Conditions of Sale. No other general or special condition communicated by the Customer may be included or derogate from these General Terms and Conditions.

The fact that MUNICH GARAGE does not invoke a breach by the Customer of any one of its obligations may not be interpreted as a waiver of the obligation in question, and to invoke this breach at a later date.

If one of several stipulations of these General Terms and Conditions of Sale is held invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will remain in full force and effect.

The fact that the Customer has not received the present general terms and conditions in his native language does not exempt him/her from applying them.

The ordering of any product proposed on the Site supposes the reading and express acceptance of the present General Terms and Conditions of Sale, and this acceptance does not require the Customer’s handwritten signature.

The validation of the order form by MUNICH GARAGE constitutes an electronic signature, equivalent to a handwritten signature, confirming that the order is complete and that the sum due for fulfilling that order is payable.

MUNICH GARAGE reserves the right to unilaterally change its general terms and conditions of the transactions made via the e-shop, in accordance with its needs and commonly accepted commercial practices, without personally informing the Customer and without the Customer being entitled to claim any compensation whatsoever. It is incumbent on the Customer to check periodically whether or not changes have been made.

The Customer may copy or print the present general terms and conditions of sale as long as she/he does not alter them.

The General Terms and Conditions of Sale applicable are those in force on the site on the date the order is placed, unless any change to these terms is required to be made by law or government authority (in which case it will apply to orders previously placed by the Customer). Changes to terms and conditions do not apply to orders which are already in progress.

ARTICLE 22

APPLICABLE LAW & DISPUTES

These General Terms and Conditions of Sale are subject to Greek law, both for rules of substance and of form.

Any complaints must first be registered with our customer service department using the email info@munich-garage.com. The Customer should first contact MUNICH GARAGE with a view to obtaining an amicable solution.

Any disputes shall be settled under Greek law by the competent Courts of Athens.

The Customer may also be able to use online dispute resolution to reach an out-of-court settlement by submitting a complaint to the Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=EN.
